Information on the processing of personal data in connection with an authorization to use an image

1) The Controller of your personal data is Oknoplast Spółka z ograniczoną odpowiedzialnością (hereinafter “Oknoplast” or “the Controller”) with its registered office in Ochmanów, Ochmanów 117, 32-003 Podłęże.
2) The Controller may be contacted at biuro@oknoplast.com.pl or in writing to the Controller’s registered office address. In matters relating to personal data protection, please contact privacy@oknoplast.com.pl.
3) Oknoplast shall use your personal date such as name, image, voice, likeness and any other publicity right (hereinafter: “Image”) within the framework of the granted consent or concluded agreement with you.
4) Your personal data will be processed:
a) in order to use the Image – the legal basis is the legitimate interest of Oknoplast consisting in the possibility to use the Image on the basis of your authorization (Article 6(1)(f) of the General data Protection Regulation 2016/679 – hereinafter “GDPR”);
b) to comply with legal obligations to which Oknoplast is subject under generally applicable provisions of law in particular accounting and tax law regulations (Article 6(1)(c) of the GDPR);
c) for possible establishing or enforcing of claims or defending against them – where the legal basis for processing is the legitimate interest of the Controller
(Article 6(1)(f) of the GDPR). The legitimate interest consists in enabling Oknoplast to pursue or defend against claims.
5) Your personal data will be transferred to entities providing Oknoplast services necessary for the use and dissemination of the work containing the Image – including marketing agencies, photographers, providers of IT systems or services, providers of social media, legal or advisory services.
6) Your personal data will be processed for the duration of your consent or an agreement with you to use your Image. If the processing of personal data is necessary for the exercise or defence of possible claims by Oknoplast, the processing period may from time to time be extended by the statute of limitations for claims.
7) Personal data regarding the recorded Image may be transferred to entities established outside the European Economic Area provided that the transmission of data has been adequately protected, meets the requirements set out in the GDPR and it is necessary for the dissemination or use of the work containing the Image. You may at any time be informed about the safeguards applied to the transfer of data outside the European Economic Area if you submit your request to Oknoplast to privacy@oknoplast.com.pl.
8) You are entitled to: access your data, request that your data be rectified or erased, limit the processing of your data or to object to data processing.
9) You also have the right to lodge a complaint with a supervisory authority responsible for personal data protection, if you believe that the processing of your data is contrary to the provisions of the GDPR.
10) The provision of data is required by Oknoplast in order to authorize the use of your Image. Failure to provide the data will render the consent and the use of the Image impossible.
